1. General Description
musicready! is an online service of the Lamotte Neuhaus Music GbR of Dusseldorf, Germany. musicready! offers custom-produced musictracks available to listen and to download for information purposes. musicready! is for: creative people in advertising agencies, directors, tv stations, soundstudios, filmproductions, and everybody who works with music. The offer does not transmit any rights for broadcasting or to perform the music in public.
2. Internal Performance
musicready! tracks can be presented internally, in a non-public environment, for the decision-making process. Public performance or broadcasting of any musicready! track is strictly forbidden without the specific permission of the Lamotte Neuhaus Music GbR
3. Exclusive Licensing
Public performance or broadcasting of any of the musicready! offerings is allowed only after written and signed approval of the Lamotte Neuhaus Music GbR. The terms and conditions for such a license are contigent to circumstance and vary for different usages.
4. Usage Information
A licensee (defined as a person or organisation who has purchased usage rights for a specific musicready! track from the Lamotte Neuhaus Music GbR) must provide all information--specifically broadcasting plans--regarding usage of that musicready! track to the Lamotte Neuhaus Music GbR.
5. Copyrights
The Lamotte Neuhaus Music GbR ensures ownership, copyrights, and intellectual property rights of the content of musicready! website.
6. Unlicensed Usage
Any un-authorized use of the musicready! works or any of the Lamotte Neuhaus Music GbR musical works is strictly prohibited, and will be enforced with legal action against the violating party.
7. Exclusive Reservation
The Lamotte Neuhaus Music GbR guarantees the right to negotiate about an exclusive licensing for the period of a reservation made by a customer. This exclusive right can only be granted to one person with correct costumer information submitted at the same time. The reservation is activated after clicking the link in an email sent to the valid email address. A written confirmation will be sent out by mail and the track will be indicated as reserved on the musicready! website. Two reservations of the same track are not possible
8. Reservation Fee
Reservation fees for a specific musicready! track can be seen in the reservation window, and is dependent on the length of time reserved. All prices are net prices to which VAT will be added if applicable. All costumer information must be correctly filled-in. The amount is due 14 days (two weeks) after invoicing. A reservation fee can be offset against the licensing fee of that specific track.
9. End of Reservation
If during the reservation period no licensing contract was entered, the track will become available for reservation again on the musicready! website, after the reservation period has expired.
10. Discontinuation of Service
The Lamotte Neuhaus Music GbR is free to end the musicready! service at any time. In this case all reservations will be valid until their expiration. No further obligations will be made.
11. Privacy
All customers data collected by the Lamotte Neuhaus Music GbR are treated with most possible privacy. No information will be made available to other parties.
12. Common Clause
Should one or more paragraph of these terms and conditions be ineffective, all other terms stay effective .
